Date: Tue, 24 Apr 1990 11:55:00 -0500 ORDINANCE NO. 9661 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, THE ZONING ORDINANCE, SO AS TO TO AMEND CERTAIN SECTIONS RELATIVE TO RESIDENTIAL USES IN C-3 ZONES, MANUFACTURED HOME REGULATIONS AND DEFINITION OF FAMILY AS SET FORTH HEREIN. __________________________ WHEREAS, the Chattanooga City Attorney has determined that there is a need to amend several sections to the Chattanooga Zoning Ordinance, Ordinance No. 6958, as amended; and WHEREAS, those amendments include clarifications of 1) the permitted uses in the C-3 Central Business Zone, 2) all residential zones except the R-5 Residential Zone regarding manufactured homes, and 3) amendment of definitions relative to "manufactured homes" and "family"; and WHEREAS, the Chattanooga Hamilton County Regional Planning staff has reviewed the proposed amendments and have concurred in recommending the proposed amendments. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, the Zoning Ordinance, be and the same is hereby amended as follows: 1. That Article V, Section 702 be amended by adding subsection (5) as follows: 0C (5) Dwelling units, multifamily units and townhouses only, excluding factory manufactured mobile homes constructed as a single self-contained unit and mounted on a single chassis. 2. That Article V, Section 101, be amended by deleting the following language: "(1) Single-family dwellings, excluding manufactured homes" and substituting in lieu thereof the following new language: (1) Single-family dwellings, excluding factory manufactured mobile homes constructed as a single self-contained unit and mounted on a single chassis. 3. That Article V, Section 122, subsection (1) be amended by deleting the following language: (1) Townhouse dwellings, excluding manufactured homes, provided that such townhouse dwellings shall meet all structural standards set forth in the Standard Building Code Adopted by the City of Chattanooga for townhouse construction. and substituting in lieu thereof the following new language: (1) Townhouse dwellings, excluding factory manufactured mobile homes constructed as single self-contained unit and mounted on a single chassis, provided that such townhouse dwellings shall meet all structural standards set forth in the Standard Building Code adopted by the City of Chattanooga for townhouse construction. 4. That Article V, Section 152, subsection (1) be amended by deleting the following language: "(1) Single-family zero lot line dwellings, excluding manufactured homes." and substituting in lieu thereof the following new language: (1) Single-family zero lot line dwellings, excluding manufactured mobile homes constructed as a single self-contained unit and mounted on a single chassis. 5. That Article V, Section 201, subsection (1) be amended by deleting the following language: "(1) Single-family dwellings, excluding manufactured homes." and substituting in lieu thereof the following new language: (1) Single-family dwellings, excluding factory manufactured mobile homes constructed as a single self-contained unit and mounted on a single chassis. 6. That Article V, Section 251, subsection (1) be amended by deleting the following language: "(1) Single-family dwellings, excluding manufactured homes." and substituting in lieu thereof the following new language: (1) Single-family dwellings, excluding factory manufactured mobile homes constructed as a single self-contained unit and mounted on a single chassis. 7. That Article V, Section 301, subsection (1) be amended by deleting the following language: (1) Single family dwellings, excluding manufactured homes, except as provided for in Section 304." and substituting in lieu thereof the following new language: (1) Single-family dwellings, excluding factory manufactured mobile homes constructed as a single self-contained unit and mounted on a single chassis, except as provided for in Section 304. 8. That Article V, Section 401, subsection (1) be amended by deleting the following language: (1) Single family, two family, and multiple family dwellings, excluding manufactured homes. and substituting in lieu thereof the following new language: (1) Single-family, two-family, and multiple family dwellings, excluding factory manufactured mobile homes constructed as a single self-contained unit and mounted on a single chassis. 9. That Article V, Section 506, subsection (1) be amended by deleting the following language: (1) Residence for innkeeper and family associated with motels, hotels, tourist homes, guest homes, travel trailer camps, and other accommodations. and substituting in lieu thereof the following new language: (1) Residence, excluding factory manufactured mobile homes constructed as a single self-contained unit and mounted on a single chassis, for innkeeper and family associated with motels, hotels, tourist homes, guest homes, travel trailer camps, and other accommodations. 10. That Article V, Section 603, subsection (16) be amended by deleting the following language: (16) Dwellings, excluding manufactured homes, when these units are located within the same building as the principal permitted use. and substituting in lieu thereof the following new language: (16) Dwellings, excluding factory manufactured mobile homes constructed as a single self-contained unit and mounted on a single chassis, when these units are located within the same building as the principal permitted use. 11. That Article V, Section 804, subsection (6) be amended by deleting the following: (6) Multifamily dwellings, townhouses, and condominiums; provided, however, that all permanent residential uses shall be located on upper floors or otherwise separated from areas of principal commercial activity; that separate and exclusive pedestrian entrances and exits for permanent residents shall be provided other than those (or in addition to those) used for access to the principal commercial area, and provided that separate and exclusive parking areas for use by permanent residents shall be maintained as outlined in Section 812. and substituting in lieu thereof the following new language: (6) Multifamily dwellings and townhouses, excluding factory manufactured mobile homes constructed as a single self-contained unit and mounted on a single chassis; provided, however, that all permanent residential uses shall be located on upper floors or otherwise separated from areas of principal commercial activity; that separate and exclusive pedestrian entrances and exits for permanent residents shall be provided other than those (or in addition to those) used for access to the principal commercial area, and provided that separate and exclusive parking areas for use by permanent residents shall be maintained as outlined in Section 812 of this Article V. 12. That Article V, Section 1203, subsection (1) be amended by deleting the following language "(1) Single-family dwellings.", and substituting in lieu thereof the following new language: (1) Single-family dwellings, excluding factory manufactured mobile homes constructed as a single self-contained unit and mounted on a single chassis. 13. That Article V, Section 1303, subsection (7) be amended by deleting the following language: (7) Single-, two-, and multi-family residential dwelling units" and substituting in lieu thereof the following: (7) Single-, two-, and multi-family residential dwelling units, excluding factory manufactured mobile homes constructed as a single self-contained unit and mounted on a single chassis. 14. That Article II, Section 100, subsection (56) be amended by deleting the following: (56) Manufactured Home: A structure, transportable in one or more sections, which is built on a permanent chassis and is designed for use with or without a permanent foundation when connected to required utilities. For flood plain management purposes the term "manufactured home" also includes park trailers, travel trailers, and other similar vehicles placed on site for greater than 180 consecutive days. For insurance purposes the term "manufactured home" does not include park trailers, travel trailers and other similar vehicles. and substituting in lieu thereof the following new language: (56) Manufactured Home: A structure, transportable in one or more sections, which is built on a permanent foundation when connected to required utilities. For flood plain management purposes the term "manufactured home" also includes park trailers, travel trailers, and other similar vehicles placed on a site for greater than 180 consecutive days. For building permit purposes there shall be affixed to a factory manufactured home the appropriate State of Tennessee certification label before same shall be considered to meet standards required for issuance of a building permit. 15. That Article II, Section 100, subsection (25) be amended by deleting the following language: (25) Family: Any number of individuals living together as a single housekeeping unit. and substituting in lieu thereof the following: (25) Family: A group of one or two persons or parents with their direct descendants and adopted and foster children, together with not more than three persons not so related, living together in a room or rooms comprising a single housekeeping unit. Every additional group of five or less persons living in such housekeeping unit shall be considered a separate family. BE IT FURTHER ORDAINED that this Ordinance shall take effect two weeks from and after its passage as required by law.
